In brief
In Trieste, in the Isonzo area, around Cervignano and Aquileia and in the Val Canale, a buyer does not become owner on signing the deed, but when the right is entered in the land register – the tavolare, a system of Austrian origin 1. This guide is for investors arriving from elsewhere in Italy or from abroad: readers who know the Austrian or German Grundbuch will find the same architecture, with differences that matter for timing and contracts. It covers where the system applies, the law behind it, how to read a register entry, how it relates to the cadastre, how to search it, how long the decree takes (in Trieste in 2026 the median between application and notice was 502 giorniRegione FVG 22) and what changes in due diligence and at completion.
Where does the land register apply?
In every municipality of the provinces of Trieste and Gorizia, and in thirteen municipalities of the province of Udine – Pontebba only for its eastern part 23. Six regional land registry offices keep it, each responsible for a group of cadastral municipalities: cadastral units that do not match the administrative municipalities, so that the City of Trieste contains several, from Barcola to Opicina to Servola 4.

Sources for the table: 234. Campolongo Tapogliano and Fiumicello Villa Vicentina were created by mergers that the Court of Trieste's list does not record 35. Outside the region the land register applies in the provinces of Trento and Bolzano, in Cortina d'Ampezzo, Colle Santa Lucia and Livinallongo del Col di Lana, in Pedemonte and the former municipality of Casotto, and in Magasa and Valvestino 136. What counts is the historical border: Sappada, part of the region since 2017 7, is not a land-register municipality 23.
One side effect for investors: for the land-register municipalities – 43 in the region on its count – the Revenue Agency publishes transaction statistics only for residential property, once a year 8.
What law governs it?
Royal Decree no. 2325 of 4 November 1928 kept the Austrian land registers in force; Royal Decree no. 499 of 28 March 1929 governs them, with an annex – the "land register act" – that is the new Italian text of the Austrian general act of 25 July 1871 19. It is living law: the consolidated text on Normattiva shows amendments up to 2025 1. From here on "art." alone refers to the land register act, "R.D." to the decree.
The region's special statute gives it primary legislative power over setting up and keeping the land registers (art. 4, no. 5) 30. The Region runs the offices and the database under a consolidated act, Regional Law no. 15 of 11 August 2010, last amended by Regional Law no. 5 of 9 June 2026 1011. Entries remain under judicial control: each office has a land register judge designated by the president of the court, who may delegate decrees on categories of documents to the registrars (arts 75 and 95-bis) 111. The opening articles track §§ 1–3 of the Austrian General Land Register Act in force today, and the three kinds of entry match those in its § 8 112.
Why does ownership pass on registration, not on the deed?
Elsewhere in Italy ownership passes by consent (art. 1376 Civil Code) and registration of the deed by transcription makes it effective against third parties (art. 2644 Civil Code) 136. Here property rights are not acquired by a transfer between living persons without entry in the land register (art. 2 R.D.), and art. 1376 of the Civil Code does not apply (art. 12 R.D.) 1. Three rules follow:
- First to file wins. In a double sale, whoever applied for registration first prevails (art. 6 R.D.), and priority follows the application's serial number (art. 29) 1, stamped with date, hour and minute 10;
- the registered owner is presumed to hold the right, until proven otherwise, against anyone claiming an unregistered right (art. 6 R.D.), and a buyer relying on the register is protected within the limits of art. 5 R.D. and arts 63 ff. 111;
- whatever is registered counts as disclosed in the contract (art. 9 R.D.) 111. For a registered charge the buyer loses the Civil Code protection against undisclosed charges (art. 1489) 13, unless the seller specifically declared the property free of it 1.

A provisional registration is justified by a declaration of the other party or by a judgment, within the deadline set in the decree; otherwise it may be cancelled (arts 41–45-bis) 1. For readers of German: it is the Austrian Vormerkung, a conditional entry (§ 8 GBG) 12, not the German one under § 883 BGB, which protects a claim to a future entry 14. The closest Italian tool to the latter is the annotation of a preliminary contract (art. 20(h); arts 60-bis and 60-ter) 1.
How do you read a land register entry?
The land register consists of the main book and the collection of documents – copies of the titles on which entries rest (arts 1 and 6) 1. The main book is divided into land register entries (partite tavolari, P.T.), numbered by cadastral municipality; each contains at least one land register unit (corpo tavolare) of one or more parcels, which changes only by adding or detaching parcels (art. 3) 11015. Anyone who knows the Austrian system will recognise the Grundbuchseinlage, its Einlagezahl and the Katastralgemeinde 31. Each entry has three sheets 10:

Readers who know the register of title in England and Wales will find the layout familiar – property, proprietorship, charges – but not the effects: here the entry itself transfers the right. For German readers: restrictions on disposal, which in Germany sit in the second section, sit here in sheet B 1532. And, as in Austria, a mortgage in sheet C shows the sum for which it is registered (art. 14), not the debt still owed 131.
Each entry carries the date and serial number (G.N.) of the application that produced it (art. 103) 119. In a technical schedule published by the City of Trieste in January 2026, sheet B registers, on an application of 2010, a sale of 1896; sheet C shows easements limited to part of a parcel marked on a plan 16. Whatever the main book refers to in the documents counts as registered (art. 5) 1: the entry must be read together with the collection.
In buildings, each floor, flat or room "suitable for separate use" can be registered as an independent unit, with its own ownership and charges sheets and its own mortgage (arts 10 and 13); detaching it from the land register unit needs a plan certified by an authorised surveyor (art. 74) 1. Anyone buying an entire building to split it goes through here, not only through the cadastre.
How does it relate to the cadastre?
The cadastre kept by the Revenue Agency records and identifies property mainly for tax purposes; the land register says who holds it and subject to which charges 211. The two registers must stay aligned: map changes pass from the cadastre to the land register by a "notification sheet", subdivisions are detached only on plans approved by the cadastre (art. 74), and decrees registering ownership go back to the cadastre (art. 123) 12.
The identifiers differ, however. In the buildings cadastre the urban section corresponds to the cadastral municipality, and the parcel is written 123,.123 or 123/4; the letter of the urban section does not always match that of the section in the land cadastre 2. For mismatches, Regional Law 5/2026 introduced a review of errors in designation or mapping and a "land register and cadastre alignment" for Theresian identifiers no longer in use, with a document validated by the Revenue Agency (arts 28-bis and 28-ter, Regional Law 15/2010) 10. The map has only secondary evidential value 11.
One question remains open: the statement of cadastral compliance that art. 29, para. 1-bis, Law 52/1985 requires on pain of nullity. For the land-register territories, Decree-Law 78/2010 left coordination to the special-statute regions and autonomous provinces 17, and the regional consolidated act does not contain it 10. Not yet verified: whether the Region has dealt with it elsewhere. Ask the notary before the deed.
How do you search it?
The land register is public and inspection at the office is free (art. 7; art. 16, Regional Law 15/2010) 110. A land register extract, current or historical, is requested from the office for the cadastral municipality: 10 euroRegione FVG per entry plus stamp duty, on the 2011 tariff still in force in 2026, within ten working days of payment 18. Copies of the computerised main book do not replace the extract (art. 14, Regional Law 15/2010) 10.
Online:
- a private individual with an Italian digital identity (SPID, CIE or CNS) can see, free of charge, the list of entries in their own name, not anyone else's 19;
- public bodies, banks, members of professional registers and other authorised users access indexes, the daybook and the computerised main book under an agreement and, for 200 euroRegione FVG a year (2014 tariff), the collection of documents 19;
- the daybook lets you follow each application by G.N., but data other than number, date, hour and minute are "merely indicative": the land register is what counts 19;
- the Revenue Agency's property registry searches and certificates are not available here 6.
Paper entries are being transferred to electronic ones 20; in August 2026 the Trieste office suspended inspection of some volumes for restoration 21.
How long does the land register decree take?
The law sets no deadline for the decision. It sets three safeguards: priority arises when the application is filed (art. 29) 110; the application is "sealed" on the entries the same day and visible to everyone from the next (art. 18, Regional Law 15/2010) 10; and the judge decides on the state of the register at that moment (art. 93) 1.
We found no official average times, so we measured them from the lists through which the offices give notice, in the Region's Official Bulletin, of decrees granting applications based on notarial deeds: the forty issues from 7 January to 7 October 2026, 10.095Regione FVG decrees 22.

In Trieste a quarter of the decrees arrived more than 673 giorniRegione FVG after the application, and almost half concerned applications from 2024 or earlier; month by month the median stayed between 449 e 544 giorniRegione FVG 22. The measure covers notice, not the signing or execution of the decree, which the lists do not date, and it cannot see applications still pending: the status of an application is read in the daybook 19. But it is notice that drives the calendar: for notarial deeds it takes effect fifteen days after publication 23, and from then run the 60 giorniRegione FVG for an appeal to the court (art. 127) – the same window within which anyone wishing to challenge the registration against third parties must have the dispute annotated (art. 63) 1. A buyer in Trieste who plans to resell, refinance or transfer the property soon must allow for this.
What changes in due diligence and at completion?
In due diligence, on top of the usual checks:
- Current and historical extracts of every entry involved, including those of easements benefiting the property 10.
- The daybook: pending applications rank ahead of the buyer's (art. 29) 119.
- Titles and plans in the collection of documents, easements included (arts 5 and 12) 1.
- A seller who inherited. Until their right is registered on the basis of the court's certificate of inheritance, nothing can be registered against them (art. 3 R.D.); for a succession opened outside the land-register territories, the certificate is requested from the court of the place where most of the properties lie (art. 13 R.D.). The heir's registration can be applied for together with the buyer's (arts 21 and 78) 1.
- Title derived from a gift. Against good-faith purchasers, cancellation of a registration based on a gift that infringes the heirs' reserved shares can be sought within three years of the donor's death (art. 64; art. 7 R.D. excludes art. 563 Civil Code) 1: while the donor is alive, time does not run.
- Someone else in possession. Adverse possession is registered only on a final judgment, without prejudice to rights acquired earlier in reliance on the register (art. 5 R.D.); the shortened adverse possession of art. 1159 Civil Code does not apply (art. 12 R.D.) 1. The protection assumes good faith: a site visit is still needed.
- Leases. A lease with a certified date before the sale binds the buyer (art. 1599, para. 1, Civil Code); a lease over nine years must be annotated (art. 19), and if it is not, it binds the buyer only for nine years from its start (art. 1599, para. 3, Civil Code; art. 12 R.D.) 113. The special rules on commercial leases are to be checked case by case with a lawyer.
At completion and immediately after:
- you need a notarial deed or a private deed with authenticated signatures carrying the exact land register references (arts 31–32); the notary, who elsewhere must arrange registration of the deed, here arranges the entry "as far as the state of the register allows" and is liable for unjustified delay (art. 11 R.D.; art. 2671 Civil Code) 113;
- to register the buyer alone, their unmarried status or the exclusion of the property from community of property with a spouse must be shown, or the application waits for the documents (arts 94-bis and 88); under community of property both spouses are registered (arts 33-bis and 84) 1;
- documents executed abroad must be legalised or, if the State is party to the 1961 Hague Convention, apostilled, and then translated; without a translation the application is annotated "pending the translation" and keeps its priority (arts 32 and 89) 124;
- a party who does not speak Italian signs a deed in their own language with an Italian translation alongside, if the notary and witnesses know it, or in Italian with an interpreter (arts 54–55, Law 89/1913) 25;
- if the deed does not show the price as paid, the judge registers the seller's statutory mortgage of their own motion (art. 97-bis): a receipt or a waiver is needed 1;
- the lender's mortgage is applied for together with the purchase, because art. 21 allows entries against someone who "is being registered at the same time" 1;
- if a party asks, the notary holds the price in a dedicated account – a ring-fenced fund that creditors cannot attach – until registration and publicity are complete and no further charges have appeared, or until an event named in the deed (Law 147/2013, art. 1, paras 63, 65 and 66) 26. Here publicity means the land register entry, through the cross-reference in art. 12 R.D. 1; with Trieste's timescales, choose the release event realistically and agree it with the notary;
- the application is filed at the counter, by post or, since 2 April 2024, electronically with a digital signature; the fee is 25 euroRegione FVG per application, 2011 tariff 2718. Registration costs fall on the buyer unless agreed otherwise (art. 34-bis) 1. Mortgage tax assessed by the Revenue Agency on the decree, where the notary has not already paid it, can be paid by F24 form even before the notice arrives 28.
Before the deed, priority can be secured in two ways:
- annotation of an order of priority: the owner, with a signature authenticated by a notary, reserves priority for a sale or a mortgage up to a maximum amount; it lasts 50 giorniNormattiva from the application; the decree is issued in a single certified copy, to be attached to the application for registration within the same 50 giorniNormattiva, and entries made in the meantime are cancelled on request (arts 53–57) 1. In Austria it lasts a year from grant (§ 55 GBG) 12. Not yet verified: if the decree granting the annotation does not arrive within the 50 giorniNormattiva, the tool is of no use; given Trieste's timescales, ask the office, through the notary, how long it takes to issue;
- annotation of the preliminary contract (art. 20(h); arts 60-bis and 60-ter), which requires a notarial deed or authenticated private deed (art. 2645-bis, para. 1, Civil Code): its effects end if the final deed, or a claim for specific performance, is not registered within a year of the agreed date, and in any case within three years of the annotation (art. 2645-bis, para. 3) 113.
Common mistakes
- Treating the purchase as complete on signing. The right arises on registration; the application only secures priority 1.
- Relying on the name in the cadastre. Ownership is read in sheet B 21.
- Reading only sheet B. What sits in sheet C counts as disclosed in the contract 1.
- Ignoring pending applications, which rank ahead and show up as seals on the entry 110.
- Buying from an heir without a certificate of inheritance 1.
- Overlooking marital status and property regime, especially for marriages celebrated abroad 1.
- Treating the online search as proof 19.
- Confusing the provisional registration with the German Vormerkung, or counting on a year of Rangordnung 11214.
- Planning in Trieste as if it were Monfalcone: from application to notice of the decree, in 2026, a median of 502 giorniRegione FVG against 22 22.
What to ask before you sign
- Current and historical extracts of every entry, dated a few days before the deed.
- Pending applications and seals on the same entries, from the daybook.
- Titles and plans from the collection of documents, easements included.
- A check that parcels, cadastral data, plans and the site match; any reviews or alignments under way.
- For an inheritance or a gift: the registered certificate and the notary's view on art. 64.
- The list of leases, with certified dates and annotation of those over nine years.
- The parties' marital status and property regime; for foreign parties, documents apostilled or legalised and translated.
- Who files the application, when, with which G.N.; the simultaneous application for the mortgage.
- Whether to deposit the price with the notary, and on which event to release it.
- For a foreign buyer, the reciprocity condition (art. 16 of the preliminary provisions to the Civil Code) and its exceptions (art. 1, Presidential Decree 394/1999) 29.
What we do in these cases
When a transaction runs through the land register, we start by reading the entries, the daybook and the titles with the buyer's notary and surveyors, and we build the relevant office's timescales into the transaction calendar.

How long does the decree take?
There is no statutory deadline. In 2026, up to 7 October, the median time to notice was between 22 e 92 giorniRegione FVG after the application at the other offices, and 502 giorniRegione FVG in Trieste 22.
What if the application is refused?
The refusal is annotated by the office (art. 99). An appeal goes to the court within 60 giorniNormattiva of notice, and to the court of appeal within thirty days if the court decides differently from the judge (arts 126–127, 130-bis); if the appeal succeeds, the entry takes effect from the time of the application (art. 132) 1.
Does someone who has occupied a property for twenty years without being registered own it?
They can obtain registration only with a final judgment, and rights acquired earlier in reliance on the register are protected (art. 5 R.D.) 1.
